Below are the Terms & Conditions applicable to the on-pack consumer promotion conducted by McCain Foods (India) Pvt. Ltd. (hereinafter referred to as ‘McCain’) and managed by 4 Minute Mile Marketing Services Private Limited (hereinafter referred to as ‘4MM’):

1.     This offer is applicable to all customers above 18 years of age and residing in India who buy from select general trade, modern trade outlets, marketplaces, e-commerce and find a QR code and batch Number on the pack.

2.     The offer is valid from 15^th Nov 24 to 22^nd Feb 25 both days inclusive.

3.     Entry for the chance to win Air fryer for the Program after 22^nd Feb’ 25 shall not be entertained and will summarily be rejected. Participation is voluntary.

4.     During the Program Period Participants will win the assured reward of Philips Discount Voucher on purchase of McCain Smiles 415 Gm & McCain Chilli Garlic Potato Bites 420 Gm. (Products available without this offer also)

5.     Additionally, till 22^nd Feb’25, Participants stand a chance to win Air fryer on purchase of McCain Smiles 415 Gm & McCain Chilli Garlic Potato Bites 420 Gm.

a)     Winners will be selected via a scientific randomizer, one for each of 100 days (from 15^th Nov 2024 till 22^nd Feb 2025) for participants from India except the state of Tamil Nadu.

b)     As per State Law, Tamil Nadu customers and any address of Tamil Nadu will not be part of the contest and are not eligible to redeem the vouchers.

6.     The Program period starts from 15^th Nov 2024 and shall continue till 22^nd Feb 2025 (inclusive of both dates). Each customer’s entry will be eligible only if the customer has participated during the program period. Any customer who participates before and after the program period, their entry will be considered invalid.

7.     The last day for the redemption of the Air fryer for Winner(s) 28^th Feb’ 25, post which requests for redemption will not be considered in any circumstances.

8.     The Program is subject to all applicable central, state, and local laws and regulations.

9.     Consumers participating or seeking to participate in the Program shall individually be referred to as “Participant” and collectively as “Participants”.

10.  Regular call and message rates will apply as per the consumer telecom operator in their respective circle.

11.  The consumer will need an internet connection to access the website link accessible through the QR code. Regular data rates will apply as per the consumer telecom operator in their respective circle.

12.  Participants purchasing the Program Pack can participate only 1 time and win only 1 time in the contest using a particular mobile number.

13.  Max. 1 air fryer prize can be won from 1 mobile number, email id, house address during the program period described below.

14.  McCain /4MM reserves the right to cancel / amend / extend the Program Period without giving any notice/intimation. No claims/questions shall be entertained in this regard. All decisions of McCain in respect of the Program and the prizes therein will be final and binding.

15.  The Employees, agents, associates, and promoters of McCain and of its affiliates, subsidiaries and advertisement agencies (including their immediate family members) and all others directly associated with organizing the Program(s) are not eligible to participate.

16.  Agreement to Terms and Conditions:

a)     By participating in this Program, Participants fully and unconditionally agree to and accept these Terms and Conditions available on www.mccainindia.theofferclub.in (“Program Website”) as well as the decisions of McCain, which are final and binding in all matters related to the Program. Successfully entering the Program and winning a prize is subject to fulfillment of all terms and conditions mentioned herein.

b)     McCain reserves the right to exclude any person from the Program on grounds of misconduct or criminal record.

c)     If this Program is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of McCain and/or 4MM, including but not limited to technical difficulties, unauthorized intervention or fraud, McCain / 4MM reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to invalidate any customer; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Program, as appropriate.

d)     If for any reason this Program is not capable of running as planned because of infection by computer virus, bugs, tampering, unauthorized intervention, technical failures or any other causes beyond the reasonable control of McCain or the 4MM, which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Program, McCain Reserves the right in its sole discretion to cancel, terminate, modify or suspend the Program.

e)     Rights to use data – By participating in this Program:

·        The participant expressly confirms and represents that he/she has read the Terms & Conditions of the Program on how to enter, and details on usage, collection, retention and sharing of personal data.

·        The participant agrees to be bound by the terms, in particular those relating to the collection, retention, use and sharing of personal data; and

·        The Participant’s personal data as collected by 4MM or McCain associates/partners or affiliates shall be passed to McCain. Personal data shall be administered and treated under McCain’s privacy and data collection guidelines.  Such data collected and retained may be used by McCain and or its related associates’/partners/ affiliates for marketing, internal study, and data analysis purposes.

·        McCain encourages participants to read the privacy notice of any such company before sharing personal data. If the Participant does not want his / her personal data to be collected by or shared with a company other than McCain, the Participant can always choose not to participate in such activity. If the Participant opts in to communications from such a company, remember that the Participant always have the right to opt-out and the Participant would need to contact that company directly to do so.

·        McCain and the 4MM shall not be responsible for (including but not limited to):- For any SPAM generated messages
– For the Operator Code not being displayed on the user’s mobile phones
– For any SMS message delivery failures
– Any lost, late or misdirected computer transmission or network, electronic failures or any kind of any failure to receive entries owing to transmission failures or due to any technical reason
– If the participant has registered himself to the DND of the telecom provider/ the participant has registered with National Do Not Call Registry/ Participant has specifically requested for not receiving messages for the specific campaign
– If the participant has shared an invalid ID and address where the grand prize can’t be delivered
– Other conditions beyond its reasonable control

17.  Eligibility:

a)     This Program will be open to all the residents of India excluding the phone numbers belonging to the employees, their immediate family members, agents, distributors, retailers and any other channel partner of McCain and 4MM.

b)     The Participant shall be above the age of 18 years.

c)     McCain or the 4MM will not be responsible for any NDNC (National Do Not Call) Registry that will come into play. All Participants who participate will agree as per the terms and conditions that even if they are registered under NDNC, DND (Do Not Disturb), McCain or the 4MM will have all the authority to call such shortlisted winners by virtue of them having voluntarily participated in the Program.
 

18.  Program Timings:

a)     The Participants who register between 12:00:01 AM to 11:59:59 PM (here in after referred as “Program Timings”) during the Program Period are eligible to participate in the Program.

b)     Time of participation will be defined as the time at which the entry is received through the registration at 4MM computer system.

c)     Entries coming outside the Program Period & Program Timings will not be considered and will be rejected summarily.

d)     The Program is applicable on McCain Smiles 415 Gm & McCain Chilli Garlic Potato Bites 420 Gm.

e)     Participants will get a chance to win the prizes below:

·        Assured Prize: Philips 10% Discount Voucher on purchase of Philips Air Fryer

·        Daily Lucky Winners: Philips Air fryer worth up to Rs.9995 on purchase of McCain Smiles 415 Gm & McCain Chilli Garlic Potato Bites 420 Gm.

f)       McCain or 4MM do not hold any responsibility for the quality of the product delivered. For any queries, the winner will be required to visit Philips authorized service centers or call 1800 572 1800 and response shared by the service center advisors will be considered as valid and final. No queries about this will be entertained at any time.

19.  How to Participate:

a)     For Assured Prize: Philips Discount Voucher

·        Customer sees the offer on the pack and participates by scanning the QR prescribed on the pack.

·        After scanning the QR code, the customer lands on the microsite www.mccainindia.theofferclub.in , and click on Participate Tab and fill the basic details: Proof of purchase, Name, Mobile Number, City, State Age and submit.

·        After Submit, the eligible customers will get the Assured voucher via SMS on registered mobile number.

b)     For Lucky Draw:

·        After scanning the QR code, the customer lands on the microsite www.mccainindia.theofferclub.in, and click on Participate Tab and fill the basic details: Batch Number, Name, Mobile Number, City, State Age and submit.

·        Every valid participant will be considered for the lucky draw process.

·        Winner – 1 winner daily for Philips Air fryer to be taken out for ROI only. This promotion is not applicable for Tamil Nadu and any address submitted which is from Tamil Nadu is not applicable.

·        Selected Winners will receive Congratulation SMS with unique code and link to fill in KYC details to claim winning prize. Post successful KYC verification, the winner will get the Philips Air fryer, which will be delivered to customers’ residence within 21 working days from the time of KYC validation and approval. In case any customer’s delivery is not possible within 21 working days with whatsoever reason, the customer will be contacted or updated via SMS/Call/Email as per the details provided at the time of registration/KYC submission

20.  Winner Selection:

a)     A draw by third party auditor through computerized randomizer will be conducted for customers from India, not being Tamil Nadu.

b)     Prizes will be given subject to the winner satisfying the verification process of McCain or 4MM.

c)     Participants have a chance to win a maximum of 1 (one) prize and 1 time only from a single mobile number, email and house address during the campaign period given above.

d)     McCain and 4MM shall have a right to ask for the original packs during the Program Period, non – submission of which shall render the Participant as not eligible to participate in the Program.

21.  Contacting Winners:

a)     Once the Winners are selected, 4MM shall process the confirmatory message with the unique code and microsite link to the registered mobile number within 48 working hours excluding public holidays and Saturday & Sundays. The winner list will also be published on the Program website www.mccainindia.theofferclub.in

b)     2 round of SMSs broadcast and 1 round of call will be made to those shortlisted winners who are yet to share their details as per process defined between 15^th November 2024 – 22^nd Feb’25. Last date to submit the details will be informed in the SMS copy.

c)     The winner list will be published on the Program website www.mccainindia.theofferclub.in

d)     McCain at its discretion may ask the Winners to furnish any or all the following documents:

·        Adhaar Card, PAN Card, Election ID Card, Passport, Driving License, or similar government ID.

·        Winners will be required to retain and furnish on demand the wrapper of the pack with the Batch number code and/or any other proof of purchase.

·        Winners may be required to furnish proof of ownership of participating mobile number (Mobile bill or a letter from their Network service provider clearly stating the mobile number, their name, address etc.)

·        Identification details (Name) on the identification document furnished should match the same on Mobile Bill / Letter furnished by network service provider.

·        Eligibility will be scrutinized by the 4MM, and they will contact the winner once documents furnished are scrutinized and found to be acceptable.

·        In case any one of the above government ID proof document is not available for any reason, the McCain / 4MM reserves the right to take a decision basis the availability of other documents. This decision will be final and binding.

22.  Redemption Flow for Assured Voucher:

a)     To redeem the Assured Voucher, participants shall follow the following steps: 

·        Participant shall scan the QR code on McCain Pack.

·        Participants will need to register on the microsite using Batch number and other details to proceed to the Assured Reward.

·        Participants click on the link which is received via SMS  www.domesticappliances.philips.co.in/mccain

·        Participants will click on Kitchen appliance on the Page and then click on the Air fryer

·        Select the Model of Air fryer-The Assured voucher is applicable on following Philips Air fryer models – HD9200/90, HD9252/90, HD9270/70, HD9280/90, HD9867/90, NA120/00, NA130/00, NA231/00, NA352/00

·        Add the product to the cart, Login with your details and then apply the coupon code in the Coupon code section.

·        Add Shipping details, Click continue to confirm order, make payment and success page will appear where order is confirmed.

23.  Assured Voucher T&C:

a)     The Assured voucher will only be provided to consumers who successfully register on the page: www.domesticappliances.philips.co.in/mccain

b)     The assured voucher can only be applied once per customer and per transaction.

c)     The assured voucher is valid till 31st March 2025.

d)     The Assured voucher is applicable on following Philips Air fryer models – HD9200/90, HD9252/90, HD9270/70, HD9280/90, HD9867/90, NA120/00, NA130/00, NA231/00, NA352/00 – Buy Philips Air Fryer Online, Fryer Machine: Philips Domestic Appliances

e)     Order fulfillment is subject to stock availability.

h)     Return Policy – Returns and Exchange of Philips Product | Philips Domestic Appliances.

i)       The voucher is non-transferable, non-exchangeable, and cannot be redeemed for cash or credit.

j)       The assured voucher is only applicable on official Philips DA website – www.domesticappliances.philips.co.in

k)     The offer is only valid during the promotional period and cannot be extended or combined with any other ongoing offer or discount, unless explicitly mentioned.

l)       The voucher cannot be redeemed on any other products apart from Philips Air fryers.

m)   The voucher is not valid on items marked as “clearance, refurbished, liquidation.”

n)     The voucher is for single-use only and cannot be re-applied for subsequent purchases, even if the original transaction is cancelled or returned.

o)     If the product purchased using the voucher is returned or exchanged, the voucher discount will not be reapplied, and the refund will be processed based on the amount paid after the voucher was applied.

p)     Only one voucher can be used per purchase, and no multiple vouchers can be applied to the same order.

q)     Consumer needs to login before applying the coupon code.

r)      Philips is not responsible for any technical issues, including incorrect or delayed voucher code entry, that prevent customers from applying for the voucher at checkout.

s)     Philips reserves the right to amend, modify, or withdraw the voucher or its terms at any time without prior notice, including in cases of suspected fraud or misuse.

t)      The voucher is valid only for purchases made within India and cannot be used on international orders or websites outside the country.

24.  T&C For Air fryer:

a)     The Philips Air fryer, Model Number- HD9200/90 will be given to lucky winners, and this cannot be exchanged with any other model of the Philips Air fryer.

b)     Once the validation is successful the Air fryer will be dispatched to address provided by the customer.

c)     Product cannot be returned/ exchanged unless the merchandise is delivered defective. In case the product delivered to you is defective, please contact our Philips customer care on 1800 572 1800 or Email id: philipshomeliving.shopsupport.india@versuni.com within 24 hours of delivery of the merchandise, in case of failure to do so, the reward shall be considered as accepted by the customer

d)     The warranty is auto applied to the products.

e)     Philips will do an address specific dispatch of merchandise. The customer shall be solely responsible for ensuring that the correct address is updated and concerned people at his home/office (as the case may be) are kept informed. 4MM/Philips will not be responsible for non-receipt of redeemed items on account of deliveries made to any other person at the registered address other than the customer. No dispatch shall be made to P.O. Box addresses or to addresses outside India or to un-serviceable Pin codes or incorrect/incomplete addresses.

f)       No change in color, fit, size, brand etc. will be entertained once the order is placed.

g)     If the gift is Returned to Origin (RTO) due to any reasons: Incomplete Address, Wrong Address, Wrong Pin code, Consignee is not available, customer refuses to receive, will not be re-attempted and will be considered as forfeited.

25.  Publicity:

a)     The Participant/s undertake and irrevocably and unconditionally permit McCain to cover the Program through various media including newspapers, radio television news channels, internet, point of sale materials, etc., and shall not raise any objection, protest or demur to such coverage or in this regard.

b)     The winners must, at the request of McCain, participate in all Program activity (such as publicity and photography) surrounding the winning of the prize, free of charge, and they consent to McCain using their name and image in Program material.

26.  Intellectual Property:

a)     All right, title and interest, including but not limited to the Intellectual Property Rights, in the Program material(s) and in all responses received shall always vest solely and exclusively with McCain. McCain or any person or entity permitted by McCain in this regard shall be entitled to use the responses received or any information in connection with the entry in any media for future Program, marketing, publicity, and any other purpose, without any permission and or payment to the Participant.

b)     All material submitted in connection with the Program (whether written, audio, electronic or visual form, or a combination of those) or any photographs, video and/or film footage and/or audio recording taken of Participants are assigned to McCain upon submission and become the property of McCain exclusively. McCain may use the material in any medium in any reasonable manner it sees fit. Copyright in any such material remains the sole property of McCain.

27.  General Conditions:

a)     Each Participant represents and warrants that he/she is legally competent to enter binding contracts under applicable laws. By taking part and/or entering the Program, the Participant warrants that all information provided by Participant regarding Participant’s name, age, state, city, address, phone number, etc., is true, correct, accurate and complete.

b)     The decision of McCain or 4MM, as regards the selection of winners and distribution of the prizes shall be final, subject only to McCain approval. No correspondence or any other claims whatsoever, in this regard will be entertained.

c)     No queries, claims, dispute, complaints or grievances shall be entertained by McCain and 4MM after 30 days from the date of the closure of the Program.

d)     The prize cannot be exchanged and is not transferable and cannot be converted into cash.

e)     Nothing contained herein amounts to a commitment or representation by McCain to conduct further Programs.

f)       The decision of McCain shall be final in all regards and no communication shall be entertained in this regard. None of the provisions of these Terms and Conditions shall be deemed to constitute a partnership or 4MM between any Participant and McCain and the Participant shall not have the authority to bind McCain in any manner whatsoever.

g)     McCain or any of its respective officers/employees/directors shall not be responsible for delayed, lost, mutilated, corrupted or illegible documents etc.

h)     McCain or 4MM shall not be liable to perform any of its/their respective obligations under the Program or in respect of the prize where it is unable to do so because of circumstances beyond its/their control in the nature of fire, explosions, natural calamities, state emergency, riots, or any other Force Majeure condition, etc., and shall not be liable to compensate the Participant in these circumstances.

i)       McCain or 4MM shall not be accountable/liable for any disruptions/stoppages/interruptions or cancellation of the Program due to any government restrictions.

j)       Failure to exercise or delay in exercising a right or remedy provided hereunder or by law does not constitute a waiver of the right or remedy or waiver of other rights or remedies on the part of McCain or 4MM.

k)     McCain or 4MM accepts no responsibility for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, loss of SMS, loss of internet connectivity, unique codes, documents, demand drafts, claims or correspondence whether due to error, omission, alteration, tampering, unauthorized data hacking, deletion, theft, destruction, virus attack, transmission interruption, communications failure, hardware failure or otherwise. McCain or 4MM shall not be liable for any consequences of user error including (without limitation) costs incurred.

l)       If a Participant is dissatisfied with the Program or the Program rules and/or any content or any requirements of the Program form, the materials available related thereto, or with these terms and conditions, his/her sole and exclusive remedy is to not participate in the Program.

m)   If a person chooses to access the Program Website from outside India, he/she shall do so on his/her own initiative and shall be responsible for compliance with applicable local laws of the country.

n)     The operational part of the Program shall be managed by 4MM .and is solely responsible to address any concerns, queries that customers may have regarding the Program.

o)     Participation in the Program is purely voluntary and the same shall be construed as an acceptance of the terms and conditions stipulated herein.

p)     The Program is subject to the guidelines/directions issued by the Telecom Regulatory Authority of India, Department of Telecommunications, and any governmental or statutory authority as may be applicable from time to time.

q)     The 4MM is not responsible for non-Delivery or receipt of an SMS by their servers or on the end user’s device due to customer handset issues, network issues or due to any issues at cellular operator’s end. By participating in this program, the customer understands that all such queries are to be directed to their current service provider directly and not hold 4MM or McCain responsible for the same.

28.  Release and Limitations of Liability:

a)     McCain and 4MM shall under no circumstances be liable, whether jointly or severally, for any loss or damage suffered or sustained (including but not limited to consequential loss), including for personal injury or property damage suffered or sustained, because of acceptance of any prize.

b)     By entering the Program, the Participant hereby releases from and agrees to indemnify McCain and/ or any of its respective officers/employees from and against all liability, cost, loss, or expense arising out of acceptance of the prize or participation in the Program including (but not limited to) personal injury and damage to property and whether direct, indirect, consequential, foreseeable, due to some negligent act or omission, or otherwise.

c)     McCain and 4MM accept no liability, whether jointly or severally, for any errors or omissions, whether on behalf of itself or third parties in relation to the prizes, the Air Fryer and the Assured Vouchers. All queries and issues in relation to the aforesaid prizes shall be directed to the relevant manufacturer and/or provider of the vouchers.

d)     The Participant shall be solely responsible for any consequences which may arise due to his/her participation in the Program by conducting an illegal act. Participant also undertakes to indemnify McCain and/or 4MM and their respective officers, directors, employees and agents on the happening of such an event (including without limitation cost of attorney, legal charges etc.) on full indemnity basis for any loss/damage suffered by McCain or 4MM on account of such act on the part of the Participant.

e)     In consideration of McCain allowing the Participant/s to take part in the Program, to the maximum extent permitted by law, the Participant/s waive and release each and every right or claim, all actions, causes of actions (present or future) each of them has or may have against McCain its respective agents, directors, officers, business associates, group companies, sponsors, employees, or representatives for all and any injuries, accidents, or mishaps (whether known or unknown) or (whether anticipated or unanticipated) arising out of the Program or related to the Program or the prize of the Program.

29.  Dispute:

a)     The courts of competent jurisdiction at DELHI shall have exclusive jurisdiction to determine all disputes arising out of, or in connection with, the Program. Participation in the Program is unauthorized in any jurisdiction that does not give effect to all provisions of these terms and conditions, including (without limitation) this clause.

b)     Further all issues and questions concerning the construction, validity, interpretation and enforceability of these Terms and Conditions, or the rights and obligations of the Participants and/or McCain and/or 4MM of this Program, shall be governed and construed in accordance with the laws of the Republic of India.
